Trump Lawyer Says Supreme Court — One-Third Appointed By Trump — Must ‘Step In And Stop’ Jan 6 Cases

 

Trump attorney Alina Habba called on the Supreme Court — one-third of which was appointed by former President Donald Trump — to “step in and stop” January 6 cases and other legal “mayhem” against Trump.

This week, the Supreme Court agreed to Special Counsel Jack Smith’s request they take up the issue of presidential immunity after Judge Tanya Chutkan denied two motions to dismiss based on First Amendment and presidential immunity claims.

But on Wednesday, the Court also agreed to hear Fischer v. United States, a case involving the constitutionality of obstruction charges against a Jan. 6 defendant.

On Wednesday’s edition of Fox Business Network’s Kudlow, host Larry Kudlow asked Habba about the just-breaking development, and she responded by issuing a broad call for the Trump-dominated court to “step in and stop” what she described as “complete mayhem”:

LARRY KUDLOW: And the other thing that’s interesting, the Supremes are going to take up the January 6 issue with respect to what’s sometimes referred to as the Enron decision. That is, you can’t bust somebody unless it’s very clear that they were fiddling with documents or otherwise stopping the pursuit of justice.

Now, this would favor Mr. Trump, or could favor Mr. Trump, but this just happened. So I’m not sure people are aware of this either.

ALINA HABBA: Yeah, I think the Supreme Court, like I said, I don’t want to speak about too many things that are pending, but I will say that the fact that they’re taking up these issues and recognizing that they need to be addressed in a world of chaos in our judicial system currently. Larry, that’s really the best way I could describe it.

And I believe someone had called on on the Supreme Court to do this exact thing. We need the Supreme Court to step in and stop this. This has become complete mayhem! And if they don’t start looking at these decisions, and as the highest court in this country, as the arbiter of law, the ultimate arbiter of the Constitution, the people that are supposed to enforce our bedrock, if they don’t start doing it, which thank goodness they are, we will have some law and order, hopefully soon.

LARRY KUDLOW: Well, people should understand the Constitution, even if Jack Smith and Merrick Garland don’t. I mean, I’ll say that, I’m not a lawyer. You’re the lawyer. But that’s the way I look at it. Free. Speech is not against the law.
